Supreme Court Upholds Deferred Action For Childhood Arrivals (DACA) Program

On Thursday, June 18, 2020, the Supreme Court held that the manner in which the Department of Homeland Security (DHS) rescinded the DACA program was unlawful. This means that, for the time being, DACA survives and DACA recipients can continue to renew their DACA status. This does not mean, however, that DACA will permanently continue because the Trump administration can try to end DACA again, nor does the decision provide any additional protection for DACA recipients.

With this decision, the DACA program should be completely reinstated to its original form, allowing the opportunity for individuals to apply for DACA for the first time and DACA recipients to apply for advance parole, which is permission to travel abroad. However, new DACA requests or applications for advance parole cannot be filed until DHS provides guidance.

Individuals interested in filing a DACA renewal, initial DACA application, or petition for advance parole should consult with an experienced immigration attorney before any filing.

La Corte Suprema confirma el Programa de Acción Diferida para los Llegados en la Infancia (DACA, por sus siglas en inglés)

El jueves 18 de junio de 2020, la Corte Suprema sostuvo que la forma en que el Departamento de Seguridad Nacional (DHSpor sus siglas en inglés) rescindió el programa DACA era ilegal. Esto significa que, por el momento, DACA sobrevive y los beneficiarios de DACA pueden continuar renovando su estatus de DACA. Esto no significa, sin embargo, que DACA siempre continuará porque la administración Trump puede intentar poner fin a DACA de nuevo, la decisión tampoco proporciona ninguna protección adicional para los contenedores DACA.

Con esta decisión, el programa DACA debe ser completamente restaurado a su forma original, permitiendo la oportunidad para que las personas soliciten DACA por primera vez y los beneficiarios de DACA soliciten un permiso anticipado para viajar (“advance parole”). Sin embargo, las nuevas solicitudes de DACA o las solicitudes de “advance parole” no se pueden presentar hasta que el DHS proporcione orientación.
